Aetheris Chat is a hosted AI sales-assistant service. For a monthly fee you get one or more chatbots that you can embed on websites you control. Each chatbot is scoped to a knowledge base you provide, and is trained to answer visitor questions from that KB, book appointments, and capture leads.

You're responsible for keeping your account credentials safe and for anything that happens under your account. One account per business entity is the intended use; agency resellers have a separate tier (Agency) that permits operating chatbots on behalf of multiple client businesses.

Plans are monthly, billed in advance through Stripe. You may upgrade, downgrade, or cancel at any time; Stripe prorates the difference automatically.

The first paid month is covered by our 30-day guarantee — if Aetheris Chat isn't moving the needle for your business, reply to any Stripe invoice within 30 days of the first charge and we'll refund it in full. No forms, no retention calls.

You agree not to use Aetheris Chat to:

• spam, harass, or deceive your visitors;
• run illegal businesses or violate third-party rights;
• reverse-engineer, copy, or resell the widget or dashboard outside of the Agency plan's white-label terms;
• attempt to extract other customers' data through the widget or API.

We may suspend or terminate accounts that breach these rules without notice.

The assistant answers from the knowledge base you provide, grounded in retrieval. It is built to say "I don't know" when a question isn't covered rather than fabricate. That said, large language models can still make mistakes — you understand that we do not warrant the accuracy of any individual response, and you'll review anything customer-facing (prices, hours, availability) before treating it as authoritative.

You own the content you upload (your website, PDFs, and other knowledge-base materials), along with any leads captured on your behalf. You grant us a narrow license to host and process that content solely to run the service for you.

We own the Aetheris Chat platform — the widget, the dashboard, the backend code, and our brand. The Agency plan permits white-labeling the widget's outward appearance; it does not transfer any IP rights to the underlying platform.

We aim for 99.9% uptime but don't formally warrant it. Scheduled maintenance windows, if needed, are announced via email. Third-party dependencies (Supabase, Railway, Vercel, OpenAI, Stripe) can cause occasional degradations that are outside our direct control.

You may cancel anytime from the Stripe Customer Portal. We may terminate your account for breach of these terms or prolonged non-payment. In either case, leads you've already captured remain exportable via CSV for 30 days after termination.

The service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, our aggregate liability for any claim arising out of these terms or the service is limited to the amount you paid us in the three months preceding the claim.

We are not liable for indirect, incidental, or consequential damages — lost profits, lost data, or business interruption — even if advised of the possibility.

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Dauphin County, Pennsylvania.

We may revise these terms as the product evolves. Material changes are announced via email to the subscriber address on file at least 14 days before taking effect. Continued use after that notice period constitutes acceptance of the updated terms.
